Rahul Gandhi’s Citizenship Under Fire: Court Demands Answers from Central Government

A fresh legal storm has hit Congress MP Rahul Gandhi as the Allahabad High Court’s Lucknow Bench has asked the Central Government to clarify his citizenship status. The court has given the Union Home Ministry four weeks to respond, reigniting a long-standing debate about whether Rahul holds dual citizenship—Indian and British.

The case, filed in the Lucknow Bench of the Allahabad High Court, stems from allegations questioning Rahul Gandhi’s nationality. The court, led by Justices A.R. Masoodi and Ajay Kumar Srivastava has scheduled the next hearing for April 21st, 2025. Before that, the Central Government must submit a detailed report on Rahul’s citizenship. The government had requested eight weeks to prepare its stance but the court granted only four.


This isn’t the first time Rahul’s citizenship has sparked controversy. The issue dates back to 2004 with claims that he might hold British citizenship alongside his Indian identity. Former BJP MP Subramanian Swamy has been a key figure in raising these allegations, claiming Rahul’s name appeared as a British citizen in records of a now-defunct UK-based company founded in 2003. Adding fuel to the fire, Vignesh Shishir, a Karnataka-based lawyer and BJP leader, filed the current petition. He alleges he has new evidence including secret emails from the British government, to back his claims.

The controversy traces back to Subramanian Swamy’s accusations in 2015 when he claimed Rahul was linked to a British firm called Backops Limited. According to Swamy, the company’s records listed Rahul as a British national, a claim the Congress party has consistently denied. Last year, the Delhi High Court also sought the Centre’s response in a similar case filed by Swamy.


Vignesh Shishir, the petitioner in the current case, has demanded a CBI probe into Rahul’s citizenship. He argues that dual citizenship violates Indian laws which could disqualify Rahul from his Lok Sabha seat as the MP from Wayanad, Kerala. The Congress, however, insists this is a political ploy to discredit their leader.


Under Indian law, dual citizenship isn’t permitted. If someone voluntarily takes another country’s citizenship, their Indian citizenship is automatically cancelled. The Overseas Citizenship of India (OCI) program offers some benefits to people of Indian origin, like visa-free travel but it doesn’t grant voting rights or the ability to hold public office.
