Patanjali Controversy: A court in Pithoragarh, Uttarakhand has imposed a significant monetary fine on Patanjali Ayurved Limited after its cow ghee sample failed quality tests dating back to 2020. The Uttarakhand Food Safety and Drug Administration collected a ghee sample on October 20, 2020 from a retail outlet in the Kasni area of Pithoragarh. When tested at multiple laboratories, the product was found non-compliant with FSSAI (Food Safety and Standards Authority of India) standards. However, Patanjali has strongly disputed the findings, calling the court order “erroneous and unlawful” and has announced plans to appeal before the Food Safety Tribunal. ·       October 20, 2020 - Sample Collection

Food safety officials conducted a routine surveillance check at a retail store in Pithoragarh and collected a sample of Patanjali cow ghee for testing. The purchase bill linked the product to Brahma Agencies (distributor) and Patanjali Ayurved Limited.

·       First Test - Rudrapur State Laboratory (2020)

The sample was initially sent to the Rudrapur state food and drug testing laboratory in Uttarakhand. The test results showed that the ghee failed to meet FSSAI quality parameters and was declared substandard. Officials identified abnormal fatty acid levels in the product, marking it as non-compliant with national food safety standards.

·       Patanjali’s Response - Request for Central Lab Testing (2021)

After receiving the failed test report, Patanjali officials contested the findings and requested a re-test at a central laboratory. The company deposited ₹5,000 as a fee to facilitate testing at the National Food Laboratory in Ghaziabad.

·       Second Test - National Food Lab Ghaziabad (2021)

On October 16, 2021 the sample was submitted to the National Food Lab in Ghaziabad. On November 26, 2021 the lab also confirmed that the ghee was unsafe and non-compliant with food safety standards. Both independent tests reached the same conclusion, strengthening the case against the product.

·       Court Case Filing and Verdict (February 2022 - November 2025)

After reviewing both lab reports, the Food Safety Department filed a case in February 2022 under the Food Safety and Standards Act, 2006. The matter was adjudicated by Yogendra Singh, Additional District Magistrate and Adjudicating Officer of Pithoragarh. On November 27, 2025, the court delivered its verdict, imposing significant fines: ₹1 lakh on Patanjali Ayurved Ltd, ₹25,000 on distributor Brahma Agency and ₹15,000 on retailer Karan General Store.

What Is RM Value.? Understanding The Technical Details

The primary issue in this case revolves around RM Value, a crucial quality parameter in ghee. RM Value indicates the level of volatile fatty acids (free fatty acids that evaporate when ghee is heated). The company stated: “The referral laboratory was not accredited by NABL for testing cow ghee; therefore, the test conducted there is not legally acceptable. It is absurd and highly objectionable that a sub-standard lab declared Patanjali’s best cow ghee as sub-standard”.

ii.               Applicable Standards At Time Of Testing

Patanjali argues that the quality parameters used to declare the sample as failed were not applicable at the time the sample was collected and initially tested. The company contends: “The parameters on the basis of which the sample was declared failed were not even applicable at that time; therefore, using them is legally wrong”.

iii.             Sample Expiry Date Violation

A critical procedural argument raised by Patanjali is that re-testing was conducted after the sample’s expiry date which violates food safety regulations. The company states this re-testing is “invalid as per law” and questions the legality of drawing conclusions from tests performed on an expired sample.

iv.             No Harm Claim

Patanjali emphasizes that nowhere in the court order has the ghee been declared harmful for human consumption. The company notes that the judgment only mentions a “minor difference” in RM Value from the standard, which is a natural process that does not affect the quality or safety of the ghee.
